1. Summary
This is a free prize draw run by IBOMEA s.r.o. We are giving away 1,000 EUR across three prizes.
No purchase is necessary and no payment of any kind will improve your chance of winning. Holding a Premium subscription gives you no advantage. Joining is free, it stays free, and one entry is a complete entry.
The draw takes place only if the Ideal Body Measurements app reaches 10,000 registered members by the closing date, which is fixed when the prize draw opens and shown on the giveaway screen. If it does not, there is no draw, no winners, and no prizes are awarded, and the giveaway simply ends.
That count is the trigger, and it is the number on that screen: the bar reading so many of 10,000 members is the figure these rules turn on. It counts registered IBOMEA accounts, and an account is a cheap thing to make. Section 9 says what that means and what we gave up by measuring it this way.
One thing worth knowing before you enter. If you win, you have 48 hours to acknowledge our email, or the prize goes to somebody else. Acknowledging means replying to say you accept it, and nothing more. Section 11 gives you 30 days to put it right if you miss that deadline anyway. Payment details and our checks have 14 days rather than 48 hours, and carry the same 30 days.
Version 3 applies to a prize draw opened under version 3 and to no other; the prize draw opened under version 1 continues under version 1 from start to finish, as section 15 explains.
This summary is here to be readable. Sections 2 to 20 are the binding rules.
2. The Promoter
This prize draw is promoted and administered solely by IBOMEA s.r.o., a company registered in the Czech Republic under IČO 14071312, at Hasova 3091/2, Modřany, 143 00 Praha, Czech Republic.
This prize draw is in no way sponsored, endorsed, administered by, or associated with Apple Inc., Google LLC, Meta Platforms Ireland Ltd, TikTok, or YouTube. None of them has any involvement in it, and you release all of them from any responsibility connected with it. Any question or claim must go to support@ibomea.com, not to them.
3. Acceptance of These Rules
By joining, you accept these rules and confirm that you meet the eligibility requirements in section 4. We record which version of these rules you accepted and when you accepted it.
Accepting these rules is separate from accepting our Terms of Service and Privacy Policy, which also apply.
4. Eligibility
To enter and to receive a prize, you must:
- be 18 years of age or older, or the age of legal majority in your place of residence, whichever is greater, at the time you enter;
- hold a registered IBOMEA account with a verified email address;
- use a permanent email address. Addresses from disposable and throwaway inbox services are refused automatically, both when you enter and when a referral is counted for someone else. If your address is an ordinary permanent one and we refuse it, write to support@ibomea.com and we will check it and put it right; and
- not be a resident of a place listed in section 5.
We ask neither your age nor where you live when you enter, and nothing in the app checks either. Both are checked before we pay, under section 14, and a winner who fails either forfeits the prize and it passes to somebody else under section 12.
Entry is limited to one entry per person and one entry per account. Nothing in the software detects that two accounts belong to the same person. Where we identify it ourselves, we will keep the earliest valid entry and cancel the others together with any tickets attached to them, following the notice procedure in section 13.
Employees, officers, and directors of IBOMEA s.r.o., and their immediate family and household members, are not eligible. This is a personal entry: no agent, syndicate, automated script, or organised entry service.
5. Excluded Territories
For legal, regulatory, and sanctions reasons we cannot offer this prize draw everywhere. Residents of the following places are not eligible to enter or to receive a prize:
Belarus, Belgium, Brazil, mainland China, Cuba, Greece, India, Iran, Italy, North Korea, Norway, Russia, Syria, the occupied regions of Ukraine, and, within Canada, the province of Quebec.
Residents of every other country and territory are welcome to enter.
What that means, said plainly. Nothing checks residence or age at entry. So somebody resident in one of those places can enter, claim social tickets, refer up to ten people, end up holding fourteen tickets, and not one of them can ever be paid. The exclusion is applied at the moment money would leave, and nowhere earlier. Read this list before you tap the button, not after you win, because afterwards is the one moment at which reading it is no use to you.
This prize draw is also void wherever it is prohibited or restricted by law, including in places not named above. If we discover that entry from a particular place is unlawful, that entry becomes invalid and any prize passes to somebody else under section 12.
6. How to Enter
You need an IBOMEA account with a verified email address that meets the conditions in section 4. If you have one, open the Ideal Body Measurements app, go to the giveaway, read these rules, and confirm that you accept them. That is the whole of it.
When you enter, we send one email to the address on your account, confirming the entry and carrying your referral code, a link you can share, and the prize table, in English or Czech depending on the language your phone asks us for. It is sent once, on your first entry only, and is the only email you will get about this prize draw unless you are drawn as a winner.
Entry is free of charge: no purchase requirement, no subscription requirement, no alternative paid route. Standard mobile data charges may apply, as for any other part of the app. No stake of any kind is required to enter or to earn a ticket, so this prize draw is not a game of chance under Czech gambling law and no gambling permit applies. No ticket will ever be attached to a payment.
The entry period opens when we open the prize draw in the app, on or after the effective date above, and we announce it there and on https://ibomea.com. It closes when the draw is run, which is within seven days of the count reaching the milestone, so entries made and tickets earned in those seven days go into the draw.
If the closing date passes with the milestone unmet, the entry period is over and there is no draw. Taking the prize draw down is something a person does afterwards, not something that happens at midnight, so for a short while the app may still show a join button and accept an entry. An entry made after the closing date cannot win anything - and nor can any entry made before it, because section 9 voids every ticket in that case, not only the late ones.
All dates and times in these rules are Central European Time, wherever in the world you live. That includes the deadlines in section 11, and any email we send you about a deadline will state the exact date and time in Central European Time.
7. Tickets and Odds
Every valid entry receives one ticket, which is a complete entry and can win any of the three prizes. You may optionally earn more in the two ways below.
a) Social follows, maximum three tickets. One ticket for following IBOMEA on each of TikTok, YouTube, and Instagram. We cannot verify a follow, so this is claimed on trust, and claiming a ticket for a platform you have not followed is a breach of these rules. Because we cannot verify it, we will not cancel an entry or refuse a prize on that ground alone: section 13 says what we may do instead.
b) Referrals, maximum ten tickets. One ticket for each qualifying referral, using your personal referral code. The ticket goes to you, the owner of the code. The person who uses it does not get one.
The message we hand you to share says something different, and it is wrong. The share text the app fills in for you, and the same text in the email we send when you enter, says the code gets you both an extra ticket. It does not. We say so here because you are the one who ends up sending that message, to somebody who has never read these rules.
A referral qualifies only when the person you refer:
- enters your referral code in the app, on an account that has not already been referred;
- verifies their email address;
- completes at least one measurement calculation in the app; and
- uses a permanent email address, on the same list and the same basis as section 4.
All four must be met, and we do not make exceptions. The fourth is applied automatically and your screen will not explain it: a referral refused on that ground sits in your pending count and never moves. If that happens and the address is an ordinary permanent one, write to support@ibomea.com and we will put it right.
When a referral ticket appears. Referrals are checked in a batch, by us, so your ticket count can lag behind reality by a few days. That check is a command a person runs: no scheduled job runs it, and running the draw does not run it either, so a referral that has met all four conditions is not in the draw until somebody has run the check. The ticket does not exist until the check creates it. We undertake to run it at least once a week and again immediately before any draw - a promise by us, with nothing in the software behind it. If your count has not moved, write to support@ibomea.com before the draw and we will run the check and tell you what you hold. A referral also only pays you once you have entered yourself; if somebody you referred qualifies first, the ticket is added by the first check after you enter.
Each person may be referred once, by one referrer, ever. You may not refer yourself or an account you control, and referrals between accounts we determine to be controlled by one person do not qualify.
The maximum number of tickets any entrant can hold is fourteen: one for entering, up to three for social follows, and up to ten for referrals.
Odds. Each valid ticket has an equal chance of being drawn, so your odds depend on how many you hold and the total in the draw, which is not fixed until the draw is run and cannot be known in advance.
8. Prizes
| Place | Prize |
| --- | --- |
| First | 600 EUR |
| Second | 300 EUR |
| Third | 100 EUR |
Total prize value: 1,000 EUR.
Prizes are awarded as cash. There is no alternative prize, and prizes are not transferable, assignable, or exchangeable for goods, services, or credit.
Tax. Where we are required as the payer to withhold tax on the prize itself, we bear that cost, so the figures above are what reaches you, wherever you live. The rest is only how that works.
If you are taxed in the Czech Republic, a prize from an advertising draw of this kind is exempt from income tax up to CZK 10,000 (§ 4(1)(f) of Act No. 586/1992 Sb.) and taxed by withholding above it. At any exchange rate in sight the second and third prizes are below that threshold; the first is above it, and we pay the tax on top rather than out of it.
Outside the Czech Republic, Czech tax can still apply, because a prize paid by a Czech company is Czech-source income (§ 22(1)(g)(6) of the same Act). It is withheld at 15%, or 35% if you live outside the EU and EEA in a country with neither a double taxation treaty nor an exchange-of-information agreement with the Czech Republic. We bear that cost too and file the withholding return Czech law requires. A treaty can reduce or remove it if you give us a certificate of tax residence, but since we bear the tax either way it makes no difference to what reaches you.
We do not report your prize to the tax authority where you live; any personal tax obligation there is yours to declare, and we recommend you take your own advice. We will provide a written statement of the prize amount, the payment date, and any Czech tax withheld, on request.
9. Draw Date
The draw is triggered when the Ideal Body Measurements app reaches 10,000 registered members, provided it reaches that figure on or before the closing date. Where a draw takes place it is run within seven days of the count reaching it, and the tickets in it are the valid tickets in existence at the moment it is run, which includes the ones earned in those seven days.
The closing date is fixed when the prize draw opens, recorded against it, and shown on the giveaway screen underneath the milestone. It is always a future date at that moment, because our own tooling refuses to open a prize draw whose closing date has already passed.
If the milestone is not reached by the closing date, there is no draw. No winners are selected, no prizes are awarded, every ticket becomes void, and the giveaway ends. This is a condition of the giveaway, not a formality: it is possible for this giveaway to end with nobody winning anything, and you should enter on that understanding.
The number, and where to see it. Members means registered IBOMEA accounts, counted from our own records; two accounts merged into one count once, and Premium does not make an account count twice. It is not a count of entrants, of tickets, or of app downloads. The giveaway screen, headed When we draw, shows that count as so many of 10,000 members, how many more are needed, and the closing date, read each time the screen loads from the same records the trigger is read from. There is no second, private number.
What we gave up to measure it that way, said honestly. An account is cheap to make. Nothing in the software stops one person creating several, and every one counts towards this milestone, so the figure can be inflated. It wins nobody a prize - section 4 allows one entry per person and one per account, and tickets come from entering, following and referring, never from signing up again - but it could bring the draw forward, which is worth something to whoever is already entered. The alternative we weighed was first-time app downloads, far harder to manufacture because each store counts one per store account. We are not using it, and you are owed the reason: those dashboards are private, only we can open them, and nothing in our systems records what they say, so a download milestone would have been a number taken by hand, published by us and checkable by nobody. We chose the figure you can watch move on your own screen over the figure that is harder to fake.
What we undertake, and what kind of promise it is. If the count reaches 10,000 on or before the closing date, we will run the draw within seven days. We will not run it before the count reaches 10,000, we will not extend the closing date of a prize draw already open, and we will not reduce the milestone.
Nothing enforces any of that. Our software counts the members and the draw tool checks the trigger, but no schedule runs the draw: a person does, and the tool can be overridden and told to draw early, or to draw after the closing date has passed with the milestone unmet - the case these rules say ends with no draw at all. It warns, and then does as it is told. Earlier versions said the draw was not at our discretion; no part of the software ever made that true, and we will not say it again. What you have instead is this document, which section 3 makes an agreement between you and us; a count you can watch on your own screen; and the fact that a promoter who advertises a prize draw and does not award the prizes it described is in breach of these rules and of consumer law wherever it was offered.
How you find out, either way. From what we publish on https://ibomea.com, and nothing else. We do not email entrants when a prize draw ends, and no screen says it ended: the app simply stops showing it, which looks the same whether the draw was run, the milestone was missed, or nothing was ever open. If the screen goes quiet, look at the website, or write to support@ibomea.com.
10. Selection of Winners
Winners are selected from all valid tickets by a fixed, published method, not by anyone choosing. We take a secret seed, then sort every valid ticket by a key: the SHA-256 hash of the text seed:ticket-identifier, as lowercase hexadecimal, in ascending order. Three tickets are drawn in that order: the first takes first prize, the second takes second, the third takes third. No entrant may win more than one prize; if an entrant's ticket comes up a second time it is skipped and the next ticket taken instead. If fewer than three entrants hold valid tickets, only the places that can be awarded are awarded.
Verifiability. Before the draw we publish a fingerprint of the seed (a SHA-256 hash) on https://ibomea.com, with the number of valid tickets at that moment, and we save that page to the Internet Archive the same day, so the time the commitment existed is recorded somewhere we do not control. We do not draw until at least 24 hours later. Afterwards we publish the seed itself, the ticket total, and the list of ticket identifiers that went in. Anyone can check the seed against the fingerprint and repeat the sort. The method is deliberately not a random number generator: it is deterministic, and that is what makes it checkable.
Where that guarantee stops. The commitment proves we did not change the seed after publishing it. It does not prove we did not try seeds before publishing one: we can see the ticket list at any time, so nothing in the arithmetic stops a promoter hunting for a seed that picks a ticket it likes. Two things stand against that, both undertakings rather than mathematics. The ticket count we publish beside the fingerprint makes a list that changed between commitment and draw visible to anyone comparing the two numbers. And between publishing the fingerprint and running the draw we cancel, disqualify and withdraw nothing; if we find a reason to do one of those, we do it before the fingerprint or after the draw, never inside that window. We would rather tell you where the guarantee stops than let you believe it reaches further.
Every step is done by a person rather than a scheduled job, and nothing in the software enforces the 24 hours or checks the fingerprint for us.
The draw is final, subject only to section 12 and to any right you have under section 16.
11. Notification of Winners
We will contact each winner using the email address registered to their IBOMEA account, within seven days of the draw.
Please read the next few paragraphs carefully. There is a short deadline here, and missing it costs you the prize.
48 hours to acknowledge. A winner must acknowledge our notification within 48 hours. Acknowledging is deliberately a very small thing: a reply saying you accept the prize is enough, and you do not need to send payment details, identity documents, or anything else to meet it. A winner who does not acknowledge in time forfeits the prize, and it passes to somebody else under section 12.
When the 48 hours start. They start when we send our email, which states the exact deadline in Central European Time. We would rather have started them on delivery, but we do not record when an email of ours was delivered, and we will not hang a 600 EUR forfeiture on a fact we could not produce if you asked for it. So we carry that risk the other way: if our email bounces, or our provider tells us it was not accepted, no deadline runs against you at all and we try again.
What we do to make the deadline fair. We send the notification on a working day, never after 12:00 on a Friday, and we send one reminder to the same address about 24 hours in. If the 48 hours would end on a Saturday, a Sunday, or a Czech public holiday, they end at the same time on the next working day.
14 days for everything else. Once you have acknowledged, you have 14 days to give us the payment details we ask for, and 14 days from each request we make for the information section 14 needs - ask on day thirteen and you have 14 days from that request, not one. A winner who does not answer within a request's own 14 days forfeits the prize. You never forfeit anything because our checks take time: the deadline runs on your answer, not on our work. A period ending on a Saturday, Sunday, or Czech public holiday ends on the next working day. You may ask for one extension of up to 14 further days on any 14-day period, without giving a reason, and we will agree unless the request is plainly abusive; if we refuse we will say why in writing, and you may take that to section 16.
30 days to put any of it right. Every deadline in this section carries the same reinstatement, the 48 hours and the 14 days alike. If you contact us within 30 days of the date we sent the notification or the request you missed, we reinstate you. You do not have to explain why you were late, or prove anything about what your email provider did with our message: this is the answer to a notification that was slow, filtered, or never arrived, and it deliberately does not depend on evidence only we hold. We do not pay a replacement drawn for a missed deadline until that deadline's 30 days have run out; section 12 covers the rare case where one has already been paid.
Where these dates live. There is no software behind this section: a person writes the notification, sends the reminder, and works out the deadline and the rollover. Our records of the draw hold that you were drawn, which ticket won, the place and the amount, and nothing else - not the date we wrote to you, not the date you answered. So your deadlines run from the date on the message in our sent mail, and we will give you that date, and the message it came from, on request. Please make sure the address on your account is one you read, and add support@ibomea.com to your contacts.
Being named, if you want to be. The notification email asks one thing only, so no deadline can be missed inside a message about something else. After you have acknowledged, we ask separately whether we may say publicly that you won, and if so how. You choose one of three:
- your username, the display name on your IBOMEA account, in the exact form we quote back to you;
- your initials, as you give them to us in your answer, never taken from an identity document you sent under section 14; or
- anonymous, meaning we publish nothing that identifies you.
We ask by email and keep your answer as you sent it, so what we publish can be checked against what you told us. We publish nothing unless you say we may, and only in the form you chose; silence is anonymous, and it makes no difference to your prize or to when you are paid. We never publish your email address, surname, measurements, or any other personal data. If you change your mind we will take our own post down, but a public post can be indexed and copied, and nobody can recall a copy somebody else already made.
Think before you choose your username. Many people use the same handle here as on Instagram, TikTok, or YouTube - section 7 encourages exactly that - so publishing one can connect this prize draw to your accounts elsewhere. We ask separately whether we may also name your country of residence, and only if you chose your username: initials plus a small country can identify a person.
If your account has no username set, that option is not open to you and we will offer initials or anonymity instead - the same if a username cannot lawfully or decently be published, for example because it is somebody else's name or trade mark, or is abusive. We will never quietly publish something other than what you chose.
12. Forfeit and Replacement
A prize passes to somebody else where the winner misses a deadline in section 11, declines the prize, turns out not to meet section 4 or to be resident in an excluded territory under section 5, is found to have breached section 13, or cannot be paid for a reason in section 14.
Who it passes to is already decided, and anyone can work it out. A replacement is not a second draw. Section 10 publishes the seed and the full list of tickets that went into the draw, and the order those produce is fixed, so the replacement for a forfeited prize is the next ticket in that published order whose entry has not already won and has not forfeited. We do not re-run anything and we do not choose: recompute the order from the published seed and you have the same answer we do.
There is no software behind this either. The tool that runs the draw runs once and refuses to run again, so a forfeit, its reason, and the replacement that follows are recorded by hand. Where a prize passes on we tell the original winner why, at the address we wrote to. A replacement winner is notified under section 11 and gets their own 48 hours, their own 14 days, their own right to ask for more time, and their own choice about being named.
Where a prize passed on because a winner missed a deadline and section 11 requires us to reinstate them, we reinstate them and cancel the replacement. Because section 11 holds a replacement's payment until that deadline's 30 days have run out, this normally takes nothing from anybody. If a replacement has nevertheless already been paid, they keep their prize and we pay the reinstated winner the same amount ourselves. We will never ask a winner to give a prize back, and nobody loses a prize because our email went astray. The most this can add to one prize draw is the prize fund over again, 1,000 EUR.
Separately, if a prize is still unclaimed 180 days after the draw we may pass it on in the same way. A prize is unclaimed only where the winner never acknowledged our notification and the 30 days in section 11 have run out - not while we are waiting on our own checks, while an extension we granted is running, or while a request still has time to run. Nothing here shortens any period section 11 gives you.
13. Disqualification
We may cancel an entry and any tickets attached to it, and refuse or reclaim a prize, where we reasonably determine that an entrant has:
- created or used multiple or automated accounts;
- used referral codes in a way designed to generate tickets from accounts that are not genuine independent users;
- given us false information about their identity, age, or place of residence in the checks we carry out under section 14; or
- interfered with the operation of the prize draw or the app.
The burden of showing one of these is ours, and it does not shift to you. Before cancelling an entry on these grounds we will contact the entrant at their registered address, set out in writing what we have found and what it rests on, and give them 14 days to respond. We will consider any response before deciding, and give that decision and our reasons in writing too. A suspicion we cannot put into writing is not a ground we act on.
A social-follow claim is not enough on its own. A fact we cannot verify is not a fact we will cancel somebody's entry over. Where we believe a social ticket was claimed for a platform that was not followed, the most we will do is void that one ticket and tell the entrant. The entry stands, the other tickets stand, and no prize is refused or reclaimed on that ground.
Cancelling an entry and voiding a ticket are both done by hand, and no screen tells you either has happened, so our email is how you will find out; if you want to know whether your entry is still live, write to support@ibomea.com. If you disagree with a decision you may raise it under section 16, and nothing here affects your right to take the matter to a court under section 19.
14. Payment of Prizes
Prizes are paid in euros by bank transfer or PayPal, whichever is available in the winner's country, within 30 days of receiving complete and correct payment details.
Before paying, we carry out the identity and sanctions checks that apply to us as a Czech company. We may ask a winner to confirm their identity, because we must know who we are paying and sanctions checks run against a name; their age, which section 4 makes a condition of receiving a prize; and their residence, which sections 4 and 5 make a condition too. This is a legal requirement on us, not a discretionary hurdle, and we ask for the minimum needed.
If neither bank transfer nor PayPal reaches the winner's country, we will agree another lawful payment method with them. A prize passes to somebody else under section 12 only where paying the winner would be unlawful, including because of sanctions, or where the winner is resident in an excluded territory under section 5, and we will tell them why. If a prize is still unpaid 180 days after the draw, we will publish that fact and the reason on https://ibomea.com.
Bank charges and currency conversion applied by the recipient's own bank or payment provider are outside our control and are not reimbursed.
15. Changes and Cancellation
We may amend these rules where an amendment is required by law or by a regulator, or where it is necessary to correct a manifest error. We may cancel or suspend the prize draw where continuing it would be unlawful or genuinely impossible.
We will not reduce the advertised prizes, introduce a purchase requirement, or make entry conditional on payment. We will not close a prize draw early, and we will not cancel or reset tickets already earned. There is exactly one case in which an open prize draw ends without a draw, and it is the one section 9 describes.
If we amend or cancel, we will publish notice in the app and on https://ibomea.com at least 14 days before the change takes effect, explain the reason, say plainly what is different, and let any entrant who has already entered withdraw. If we cancel after the entry period has opened, we will still conduct the draw among valid entries unless that is itself unlawful or impossible.
How to withdraw. There is no withdraw button in the app, and we are not going to point you at one that does not exist. Write to support@ibomea.com from the address on your account and say you want your entry withdrawn. A person takes the entry and its tickets out of the draw within five working days and confirms by email. Withdrawing touches nothing else on your account, and tickets other people earned by referring you are not affected.
Versions, and the prize draw that came before this one. The version you accepted governs your entry, except where a later version is required by law. When you join, the server compares the version your screen showed with the version the prize draw was opened under and refuses the entry if they differ, so an entry can only be governed by the version its own prize draw was opened under.
Version 3 changes what the closing date means, how long a winner has to reply, and how a winner may be named - none of them a change this section allows us to make to a prize draw already open, and we are not making it to one. The prize draw opened under version 1 continues under version 1 in full until it has been drawn and its prizes settled: version 1's promise that the draw happens on 31 December 2026 whether or not the 10,000-member milestone is reached, and version 1's 30-day period for a winner to respond. If you entered under version 1, nothing in version 3 applies to you.
There is no version 2: version 1, published on 26 August 2026, is the only version we have ever published, and no entry is recorded against a version 2. We leave the gap rather than renumber, because the version number is the only thing tying a recorded acceptance to the words that were on screen.
Reading the version that governs you. We publish one set of these rules at https://ibomea.com/giveaway-rules, and it is the current one, so once version 3 is published version 1 is no longer on the website. That is a real limitation and we will not dress it up. Two things stand in its place. The first is a lock rather than a promise: the tool that publishes these rules refuses to publish a new version while a prize draw is open under an older one. That is also why these rules take effect on the day they are published rather than a date fixed in advance, and why a prize draw's closing date is set when it opens. The second is that if your entry is governed by an earlier version, write to support@ibomea.com and we will send you that version's exact text. Nothing in a version you did not accept binds you, whatever the website is showing.
16. Complaints and Disputes
If something about this prize draw goes wrong for you, write to support@ibomea.com. We will acknowledge within five working days and give a substantive answer within 30 days.
If we cannot resolve your complaint between us and you are a consumer, you may put it to the Czech Trade Inspection Authority (Česká obchodní inspekce), Ústřední inspektorát, Gorazdova 1969/24, 120 00 Praha 2, Czech Republic, https://www.coi.cz, through its portal at https://adr.coi.cz. We should tell you plainly that its out-of-court service covers disputes under a contract for which the consumer paid, or agreed to pay, a price, and entry here is free, so it may decline the case on that ground. If it does, that changes nothing about what we owe you under these rules, or about your right to bring court proceedings under section 19.
17. Personal Data
IBOMEA s.r.o. is the controller of personal data processed for this prize draw. This section is the full account of it; our Privacy Policy covers the app and the website and points here for the draw.
What we process. Your referral code, which the app creates the first time you open the giveaway screen, whether or not you go on to enter; that you entered and when; the version of these rules you accepted; the tickets you hold and how each was earned; who referred you, and who you referred; and, if you win, the contact and payment details needed to pay you, the identity information section 14 needs, and your answers to the questions in section 11 about being named.
Our records of the draw itself hold only that you were drawn, which ticket won, the place and the amount. Everything else about a win - our notification, your acknowledgement, your answer about being named, and any initials or country you gave us - exists as the email it was written in and nowhere else, which is also how we can show what you agreed to and why section 11 runs its deadlines off our sent mail.
Checking a referral. To decide whether a referral has qualified under section 7 we look at three facts about the person referred: whether their address is from a disposable-inbox service, whether they have verified it, and whether they have completed at least one measurement calculation. We check only that a calculation exists, and never read or disclose any measurement or other body data. The referrer is told only that a referral has qualified and a ticket added.
Why we may process it. Running the prize draw and paying prizes is performance of the contract formed by these rules. Preventing fraudulent and duplicate entries is our legitimate interest in running a fair draw. Publishing a winner's name is done with the consent section 11 describes, withdrawable at any time by writing to support@ibomea.com and as easily as it was given; withdrawing does not make what we published before then unlawful. We keep the messages in which you agreed and withdrew. Retaining records for accounting and sanctions purposes is a legal obligation.
How long we keep it. Entry and ticket records are kept while the prize draw is open and its prizes are being settled, and deleted once the draw is complete and any connected legal, accounting, and tax obligations have been met. We do that by hand, and no scheduled job sweeps them, so if you want to know whether yours are still there, write to support@ibomea.com. The record of who referred whom is kept as long as both accounts exist, because section 7 limits each person to being referred once, by one referrer, ever, and we cannot enforce that without it; if either account is deleted, that record goes with it. One trace stays: a ticket earned by referring somebody carries a reference to the account it was earned for, and we do not take back a ticket already earned, so that reference stays on the referrer's ticket after the other account has gone. It is an internal number with no name and no address in it, and nothing that can be turned back into a person once the account it pointed at is deleted. Records we are legally required to retain, principally those relating to prize payments, are kept for the statutory retention period and no longer.
Your rights. You may request access to, correction of, or deletion of your personal data, object to processing based on legitimate interests, and lodge a complaint with a supervisory authority - in the Czech Republic, the Office for Personal Data Protection (Úřad pro ochranu osobních údajů), https://uoou.gov.cz. Our Privacy Policy sets out these rights in full, and lists the providers that process this data for us, where they hold it, and how transfers outside the EEA are covered.
Deleting your account. Deleting your IBOMEA account removes your entry once the deletion takes effect. Deletion is not immediate: it starts a grace period, you can cancel during it, and until the account is actually deleted your entry and tickets stay in the draw.
If you have been drawn as a winner, write to support@ibomea.com before you ask to delete your account. A prize record is attached to your entry and stops a deletion from completing cleanly. Tell us instead and we will settle the prize first, or, if you would rather not take it, record it as declined under section 12, pass it on, remove the prize record, and then delete your account in the ordinary way.
If we have already paid you, we must keep the record of that payment for the statutory retention period, and a record of a payment necessarily says who was paid; your entry, tickets and award record are kept with it. Deletion is therefore partial for a paid winner: everything the app holds about you goes, and so does your sign-in, but the account record carrying your email address, referral code and prize-draw records is kept until that period ends. Write to support@ibomea.com and we will tell you exactly what is kept, why, and when it goes.
18. Liability
Nothing in these rules limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded. Nothing in these rules affects your mandatory rights as a consumer.
Subject to that, we are not liable for:
- entries that are not received, or are received late or incomplete, because of a technical failure outside our reasonable control;
- any interruption to the app or to the entry process caused by an event outside our reasonable control; or
- any tax, charge, or cost incurred by a winner beyond those we undertake to cover in section 8.
If you believe an entry of yours failed to reach us, contact support@ibomea.com and we will investigate.
19. Governing Law and Jurisdiction
These rules and any dispute arising from them are governed by the law of the Czech Republic.
If you are a consumer resident in the European Union or the European Economic Area, you keep the protection of any mandatory provisions of the law of the country where you live that cannot be derogated from by agreement. You may bring proceedings against us either in the Czech Republic or in the courts of the country where you live, and we may bring proceedings against you only in the courts of the country where you live. Nothing in this section removes a right of that kind.
Where the paragraph above does not apply, the courts of the Czech Republic have jurisdiction.
20. General
If any provision of these rules is found to be invalid or unenforceable, the remaining provisions continue in force.
These rules, together with our Terms of Service and Privacy Policy, are the entire agreement between you and us in relation to this prize draw.
Languages. These rules are published in English at https://ibomea.com/giveaway-rules, and the English text is the binding one. The giveaway screens in the app are a short summary for convenience and never change what these rules say: where a screen and these rules disagree, these rules govern. For a Czech translation write to support@ibomea.com; where a translation differs from the English, whichever version is more favourable to you as a consumer applies.
